TERMS & CONDITIONS
These terms and conditions apply to all purchase orders submitted to Avalyn & Lulu’s webshop on www.avalynandlulu.com (in the following referred to as the ”webshop”), this covering all purchase agreements that a consumer enters into from a distance with Avalyn & Lulu AB, hereinafter referred to as ”A+L”. We encourage you to read these terms and conditions in their entirety before submitting an order. These terms and conditions may be updated and vary from time to time why we ask you to read the terms and conditions previous to every order you place in the webshop.
A binding purchase agreement is entered into as soon as your order has been confirmed by us and an order confirmation has been sent from A+L to the e-mail address you submitted. If an item happens to run out of stock before the status has been correctly updated on the webshop, A+L will notify you of this by email. We may then suggest an alternative item, or cancel the order in question. If incorrect price information has been shown on the Webshop you will be offered to either purchase the item to the correct price, or cancel the order. A+L reserves the right to decline or rescind a purchase agreement if fraud or other actions similar to fraud, such as unlawful use of another person’s credit card, can be suspected.
To place an order in the webshop you must be at least 18 years old and not under guardianship. A+L presumes that minors who carry out purchases on www.avalynandlulu.com submit truthful information of their age and/or possess the necessary consent from their custodian to purchase the item(s). If not, the buyer may become liable for the possible costs an invalid agreement may involve.
PRICES & VAT
All charges will be in Swedish krona (SEK). The prices at the webshop are current prices and may changed at any time. A+L is not bound by price indications in the webshop which the buyer must reasonably or apparently understand are incorrect and which, for example, have occurred due to technical problems in the web platform or rates that have been manipulated by the customer. Shipping costs will be calculated or added to your order at checkout.
In the webshop prices are displayed for each item. If you country is part of the European Union (EU) the prices include Swedish VAT at 25%.
Orders to countries outside EU may be subject to VAT, import duties and/or taxes, which are applied once your package reaches your country. A+L pays for the customs fee, but we do not collect VAT and/or other import taxes on orders to countries outside the EU and we cannot predict what your particular charges may be. Please contact your local customs office for more information.
Your credit card will be charged in Swedish krona (SEK) and then converted to your local currency on your bank statement. A+L cannot be held responsible for any variations in the exchange rate between the two currencies. You can choose to display your preferred currency on the webshop from the currency selector. This currency selector connects automatically to xe.com to give the most current exchange rates.
Payment can be made by credit card, Swish (Sweden), Paypal or as may otherwise be instructed at the webshop. Where payment is subject to validation and/or authorisation by a card issuer or bank or to credit validation, any Order Confirmation is subject to such validation or authorisation. We cooperate with an authorized payment service provider (Stripe, Quickpay and Paypal), who processes your personal details in accordance with the international security standard PCI DSS. All transactions will be sent through SSL (Secure Sockets Layer) in encrypted form and all card details and payment information will be protected and processed with high level of security.
CHARGING YOUR CREDIT CARD
We will not charge your credit card until the date we ship your order to you, however the total order sum is reserved until your order is dispatched (may vary between banks). All orders are subject to verification and acceptance before shipping.
A+L reserves the right to check the cardholder’s address, the card’s validity, and that your account has the capacity to be charged with the full amount. A+L reserves the right to decline a purchase.
PROMOTIONS & DISCOUNT CODES
All campaigns with reduced price are limited in time. Multiple offers can normally not be combined. A discount code or voucher is only valid once per customer and purchase. In case of obvious misuse of offers, such as coupons and promotion codes, the webshop reserves the right to cancel the order in question.
On orders eligible for a gift or discount the value of the gift/discount is considered as a general discount on the total amount of the order. If part of or the entire order is sent back for exchange or refund the value of the returned merchandise is recalculated and the purchase price minus the relative share of the overall discount will only be credited.
Promotions and discount codes are only valid on new orders and cannot be applied retrospectively.
A+L ships to over 40 countries at the moment. We want you to be able to use your purchased item(s) as soon as possible, therefore we only uses the most efficient shipper (DHL / DB Schenker / Bring / Postnord).
The shipping cost is calculated and shown before you complete your order. All orders are processed within 1 business days from Order Confirmation and can be expected to be delivered in 2-4 business days within Sweden and 3-10 business days on International orders. Delivery times are estimated only, and particularly during high season (e.g. Christmas), deliveries may take longer than normal.
If a package delivered is not collected, we reserve the right to charge you a fee of 150 SEK (~€15), covering the entire cost of the shipping and processing. Non-collected packages are normally not covered by the right to return items. The fee corresponds to the actual costs of return, handling fee and handling in total. Payment terms are 30 days. In case of late payment, a reminder fee (the amount allowed under the law of 50 SEK (~€5) is payable as well as late payment and, if applicable, collection costs. If you repent when the package has been sent from us, you will need to pick up the package at your service center and return it to us with the customer return or contact us and tell you that you are unable to retrieve the package.
PROBLEMS WITH YOUR SHIPMENT
– If your order has not arrived within the estimated time frame, please either contact your specific carrier directly or contact A+L.
– If you have received an item that has been damaged during shipping, please contact the shipping company first and then contact A+L.
– If you notice something that you think is a defect or production error with your A+L item, please contact A+L within 14 days. A+L will cover the shipping cost and we will do our absolute best to replace a defective item or we will fully reimburse you.
– If items are not defective but do not fully meet your expectations, please see the “Returns” category below.
You are always entitled to return your items within 30 days from the day the package have been delivered. The return-shipping costs are paid by A+L (within Sweden and one per order).
For the return to be accepted the returned items must be essentially in the same condition in which they were sold and with any seals intact. This does not apply if the items were damaged or otherwise changed due to any measure necessary to examine them, or due to any other circumstance not related to the consumer.
A+L will repay the price of the item as soon as possible, however at the latest within 30 days from the date the item was returned and received by us.
The refunds will be returned to your original method of payment.
Please note that the product must be returned unused, with hygiene stickers (applicable to all bottoms and one pieces) and in original packaging including all tags.
A+L ensures that all products are meticulously checked in a quality control before being dispatched to our customers. We work hard to avoid the emergence of damages or defects in our products. Should you find that an item despite this is damaged or otherwise defective, you will be replaced with a new sample of the item in question, if a new one is available. If not, you will be refunded with the original cost of the item and the return cost, unless the defect can be repaired. If the damaged item followed an order containing other purchased items the cost of the original delivery will not be repaid. You are asked to always examine your received products already at the time of delivery and as soon as possible report any deviations from your order confirmation to us.
We will return your funds as soon as possible, at the latest within 30 days from the date you returned the item and it was received by A+L, and we have established that the item is damaged or otherwise defective. Always save your receipt. The funds will be returned to your original method of payment.
COLLECTION AND USE OF PERSONAL DATA
A&L uses the personal data necessary for the order-, invoicing- and delivery processing. The customers’ data is recorded in the A&L customer register, the data included in which is used for the processing and follow-up of the order, the delivery of the package and the care and maintenance of the customer relationship.
A&L subcontractors processes the customer’s personal data in accordance with the laws relating to data protection applicable in European. We do not sell, distribute or rent the data to third parties. A&L does not transfer the collected personal data to third parties for purposes other than those relating to the processing of the order or possible debt collection measures. A&L retains the right to transfer data relating to a customer to the authorities if the customer has acted against law or contrary to good practice.
The customer has the right to review, rectify or erase the data on him/her from the customer register. For this purpose, please make a request in writing to the address firstname.lastname@example.org. Access to the register is prohibited from persons other than those employed by A&L and our subcontractors.
Customers subscribing to A+L newsletter will get inboxes about new item arrivals and insider offers for purposes of marketing. Customer can easily unsubscribe from the newsletter at any time.
We cannot guarantee that the colors appearing on the webshop in detail reflect the clothes’ colors in reality. The colors can be reflected in different ways depending on for example your computer or phone screen, graphic card and the computer settings.
